Sindh High Court issues notices to tax authorities on M/s Hero Motors petition

KARACHI: Sindh High Court (SHC) issued notices to tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s Hero Motors Private Ltd seeking restoration of its sale tax registration suspended by tax authorities due to alleged involvement in issuance of fake invoice case.

The two-member bench headed by Justice Aqeel Ahmed Abbasi directed the respondents to file their respective Para wise comments on next hearing. The court adjourned the hearing for January 20, 2017.

Sources told that counsel for the petitioner stated in its constitutional petition that petitioner is engaged in manufacturing of tractors and paying all liabilities regularly and registered with having in-house assembling/ manufacturing facilities for Hero Russi 500 Tractor 50HP, Hero Russi 510 Tractor 57HP and Hero 801 Tractor 81HP. Adding that the tax authorities issued show cause notice and suspended the sale tax registration of the petitioner alleging that petitioner was involved in issuance of fake invoice and tax fraud. Counsel stated that no fake sale tax invoice was issued by the petitioner therefore act of the respondents is illegal and mala fide.

Citing sectary revenue division, commissioner Inland Revenue zone1 Regional Tax Office Hyderabad as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary. The petitioner also pleaded the court may set aside impugned notice of the respondent and order to restore its sale tax registration.
