M/s IR Trading Co approaches SHC for release of consignment

KARACHI: The Sindh High Court (SHC) adjourned the hearing of a constitutional petition filed by Zeeshan Ali authorized of M/s IR Trading Co seeking release order of its consignment of 1,200 kg of electric goods/Hyundai brand circuit breakers of Korean origin.

A two-member bench, headed by Justice Munib Akhtar, was hearing the petition. The court adjourned the hearing for January 30, 2017.

Earlier, counsel for petitioner stated that petitioner’s company imported and cleared a consignment of 1,200/kg of electric goods at grossly under invoiced value through submission of vide goods declaration No: KAPW-HC-88867 dated 08/11/2016 through model custom collectorte appraisement, west, on payment of total taxes amounting to Rs103 258.

According to petitioner, consignment was selected for examination and during the examination, officials of the customs authorities alleged that petitioner filed goods declaration through self-made bogus invoice which was submitted to customs on filling of goods declaration. The total value of the goods was declared at $2364, however goods were assessed by the collectorate @ $2.55/kg ($3000).

Citing secretary, ministry of finance, collector of customs model collectorate, appraisement west, deputy collector of customs adjudication, model customs collectorate and director general intelligence & investigation-FBR as respondents, importer pleaded with the court to declare that act of customs authorities illegal, mala fide and arbitrary.

He also pleaded with the court to allow the deposit of deferential amount of duty fine and penalty for release of goods.
