Customs Appellate Tribunal seeks reply on petition filed by M/s Khyber Autos

KARACHI: Special Customs Appellate Tribunal has ordered issuance of notices to Collector Customs West and Collector Customs Adjudication for February 13 in an appeal filed by Khyber Autos, an importer of auto parts. The tribunal was comprising Member Judicial Tahir Zia, and Member Technical Nazim.

According to the details, the bench heard the arguments by Adnan Motan advocate who submitted that the custom authorities came up with the charge of mis-declaration in description.

As per goods declaration filed by the petitioner, the items imported are “turning shaft bush which fall under PCT Heading 8483.3020 carrying zero percent custom duty. The custom disputes the same and maintains that it were auto parts classifiable under PCT Heading 8483.6092. The counsel Adnan Motan maintained that upon re-examination of the subject consignment, it was found that items disputed carries custom duty at a rate of 35 percent.

The counsel drew the attention of the court towards the re-examination report which re-affirmed that the consignment consists of auto parts and that the country of origin (China) was also stated. Today the tribunal comprising Tahir Zia, Member Judicial and  Nazim Saleem, Member, Technical referred the appeal to chairman of the tribunal as the money involved was less than Rs 5 million.
