Customs court grants bail to suspect booked in mega tax evasion case

KARACHI: Custom Court Judge Syed Faiz Rasool Rashdi granted an interim pre-arrest bail to an accused named Faiz Rehman S/o Faisal Akbar Khan who was booked in duty and taxes evasion case of Rs05.00million.

During the hearing, counsel for applicant/accused filed an application for interim pre-arrest bail and argued that applicant/accused is innocent and was falsely implicated in this case as he is ready to face trail, however he has apprehension of arrest therefore court may grant his bail till final decision of this case.

After the hearing, court granted his bail and observed in its order that “Without touching the merits of the case, an interim pre-arrest bail is granted to said accused subject to furnish surety of Rs. 200000 with P.R bond in the like amount to the satisfaction of this court. The custom court also directed the accused to join the investigation if and when required by the investigation officer and appear before the court on the next date of hearing. The court also called the police papers.

It needs to be mentioned here that on last date of hearing, court had issued non-bailable arrest warrant against the absconding accused persons namely Waseem Hassan S/o Ghulam Hassan, partner of M/s Suaheha International Trade, Abdul Hafeez S/o Abdul Ghani, partner of M/s A-One Oriental, Waseem S/o Abdul Ghani and Faiz Rehman S/o Faisal Akbar Khan and had directed investigation officer to arrest and make them appear before the court prior to the next date of hearing.

According to the prosecution, during the investigation, it was revealed that the above named accused persons evaded duty and taxes of Rs04.8 and incurred a loss to the national exchequer. Therefore a case was registered against them in violation of Section 19, 32 (1) (2) 32 (A) 79, 172 punishable under clauses 10 (A) 14, 14 (A) 47, 77 and 86 of section 156 (I) Ibid read with section 3 (b) & 6 of the Sales Tax Act-1990 punishable under Section 33 ibid and Section 148 of the Income Tax Ordinance-2001.
