PCA lodges criminal case against company owner for mis-declaration

ISLAMABAD: Directorate General Post Clearance Audit (PCA) has detected the mis-declaration, fraud and smuggling in the import of used prime movers by a construction company M/s Bisma International Karachi.

According to the details, the criminal case has been registered against the owner of the company Imtiaz Ahmad Khan son of Sobay Khan and two others under the section 2(s), 16, 32 and 79 0f the Customs Act, 1969.

The case was forwarded to the court of special judge of Customs Islamabad for legal hearing by the Deputy Director Headquarters I&P Cell Islamabad Muhammad Nauman Tashfeen.

Post Clearance Audit has seized the four used prime movers as case property and value of the goods is Rs10 million.

According to FIR, importer knowingly and fraudulently got these used prime movers released from Customs without establishing his bona-fide  being a genuine construction company and without any verified construction projects, hence , without establishing the eligibility and entitlement to import these used prime movers in terms of para 9(ii) (5) of the IPO 2012-15, (the restriction and the restriction being that import of such used specialized vehicles was only allowed to genuine and bonafide construction companies and to the extent of quantity in commensuration with their verified construction projects).

The importer and other has committed fraud mis-declaration and smuggling in terms of sections 2(s), 16, 32 and 79 of the Customs Act 1969, read with SRO,556(1) 2005 dated 06.06.2005 and section 3(1) and (3) of the import and export (Control) Act 1960.
