FBR for exempting charitable hospitals from NOC for importing medical equipment

ISLAMABAD: The Federal Board of Revenue has suggested in the budget the proposals that import of machinery, equipment, apparatus, appliances, instrument, wheelchairs, medical, surgical and dental furniture by the charitable non-profit making institutions, operating hospitals of 50-bed or more than 50-bed hospitals run by the federal or a provincial government, will no longer need to obtain No Objection Certificate from the Federal Ministry of National Health Services Regulations and Coordination (NHSRC). It may be remembered that after the 18th amendment in the constitution the subject of health has been transferred to the provinces. In case of import of such things, the head of the organization shall furnish a undertaking but there will be no condition to certify this by the Ministry of National Health Services Regulations and Coordination (NHSRC). This condition will also apply to defence and army institutions. The said hospitals shall furnish a proof thereof to the satisfaction of respective collector of customs. (b) the head of the importing institution or hospital shall furnish an undertaking in writing to the respective collector of customs to the effect that imported goods are bona fide requirement of the project or for in-house use and these shall not be sold, utilized or disposed of otherwise than for the purpose for which the same have been imported and binds itself to pay the duty and taxes in case of breach of the undertaking.

It is important to mention here that in Customs Tariff 2016-17 this condition has been imposed on charitable organizations and non-profit making institutions that undertaking so furnished by the hospital or institution will be attested by the Ministry of National Health Services Regulations and Coordination (NHSRC) and in case of Provincial Government hospitals or institutions or charitable non-profit making institutions by the Secretary of the Health Department of the province where such hospital or institution is situated. Now according to new budget proposal, only undertaking from the head of organization will be furnished before the Customs Collector.
