IHC adjourns hearing of four tax references filed against FBR

ISLAMABAD: In recent week, the Islamabad High Court (IHC) ‘dated in office’ the hearing of four tax references, involving matters related to the Federal Board of Revenue (FBR).

In the post Eidul FItr proceedings, IHC Judge Justice Aamer Farooq heard the cases filed by M/s Saudi Pak Industrial and Agricultural Investment Company Limited, M/s Wi-Tribe Pakistan Limited, M/s Orient Power Company Limited and M/s Telecom Mobile Limited.  A single bench of the Islamabad High Court adjourned the hearings by dating the cases in the office.

All of the appellants had filed cases against the FBR and its field offices. M/s Saudi Pak Industrial and Agricultural Investment Company Limited has named assistant commissioner Inland Revenue as main respondent in the case besides other officers and M/s Wi-Tribe Pakistan Limited, M/s Telecom Mobile Limited and M/s Orient Power Company Private Limited had named the FBR  as the main respondent besides officers of the Large Taxpayers’ Unit, Islamabad.

All four appellants had challenged different show cause notices issued by the filed office of FBR claiming payable outstanding tax amounts.

They had prayed the court to provide them relief against the notices, what they say illegal, and restrict FBR from realizing recovery of tax amounts.

It was submitted before the court that the impugned order was issued under mala-fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard. It also stated that due legal course was not followed by the department in issuing the order.

The petitioner had prayed the court that issued order by the tax authority may kindly be suspended till the decision of appeal pending before the field office of Federal Board of Revenue (FBR).
