KARACHI: The Sindh High Court (SHC) has directed parties to file their comments on a constitutional petition filed by M/s Kinijhar International, seeking exemption of duty and taxes on consignments of LED bulbs etc as entitled under 5th Schedule of the Customs Act 1969.
According to the details, counsel for the petitioner stated that THE petitioner is engaged in the lawful business of import of LED Bulbs etc and always fulfills all the liabilities properly.
He said that in routine, te petitioner imported consignment of LED bulbs 12 watt, 15 watt, 18 watt, 25 watt 40 watt and other related goods and filed goods declaration under availing exemption as entitled under 5th schedule of the Customs Act 1969.
He further informed the court that however, officials of the Customs Collectorate of Appraisement West who has not accepted the assessment made by the petitioner on the pretext that the petitioner’s goods are not entitled for relevant exemption as per assessment.
Citing Chairman Federal Board of Revenue, Collector of Customs Collectorte Appraisement West, the Engineering Development Board Alternate Energy Department Board as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to declare that the above mentioned goods are entitled under 5th Schedule of the Customs Act 1969.
