SHC appellate bench orders release of LED lights, toilet soap consignments

KARACHI: A Singh High Court appellate bench has ordered provisional release of LED lights and toilet soap consignments.

The SHC appellate bench, comprising Justice Munib Akhtar and Justice Omar Sial, ordered provisional release of LED lights on same terms and conditions as were ordered in earlier petitions.

The bench earlier heard Hyder Shaikh advocate of Franklin Law Associates representing Rana Enterprises, Aleem Enterprises and Jutt Mills who claims exemption on their consignments on ground that LED lights are given exemption in order to conserve electricity under a government policy. The Customs, however, denied the benefit of the exemption against which dozens of petitions have been filed.

The same bench earlier hearing identical petitions has ordered provisional release of the LED lights and as per rule of consistency the release in instant petitions was allowed.

Meanwhile, the same bench ordered provisional release of consignments of toilet soaps while hearing a petition filed by Zaki Enterprises. The petitioner challenged the power of the Director General, Valuation regarding enhancement in value of goods ignoring Valuation Ruling.

Hyder Shaikh advocate appearing for the petitioner submitted that court has ordered release of toilet soaps on condition of paying differential amount of duty and taxes between declared value and value as per valuation ruling. The bench allowed the release on the ground of consistency.
