The bench asked the counsel for Pakistan Customs that whether Supreme Court seized with the hearing of a Civil Petition for Leave to Appeal (CPLA) has passed any order of restrain or suspended operation of order of the SHC bench. As copy of the apex court’s order was not available or produced by the applicant/ appellant department, the bench asked the counsel for department to produce the copy of the order by next date of hearing.

In case there is no restraining order, the consignment shall be released or contempt proceedings would be initiated, the bench warned putting off further proceedings till Nov 28.

The consignments of grey fabric were detained by the Customs authorities on ground that these were not of Chinese origin as declared but were of Indian origin.
