M/s Goldway challenges valuation’s enhancement of non-woven diaper’s material

KARACHI: The Sindh High Court (SHC) issued notices to the customs authorities and Deputy Attorney General of Pakistan on a constitutional petition filed by M/s Goldway Hygiene Products challenging the enhancement of valuation of a consignment of non-woven raw material for diaper imported from China.

Hearing the petition, a two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, also directed that para-wise comments should be filed on the next date of hearing.

Earlier, counsel for the petitioner stated that it is engaged in the lawful business of import of non-woven raw material for diaper from China. It has imported abovementioned goods weighed 23830.10 kg unit price @ 2.10$ and filed Goods Declaration according to the law.

He submitted that, after filing Goods Declaration, it has paid Rs1.2million as duty and taxes accordingly. However petitioner is seriously aggrieved by the act of the respondents who determined the value from unit price @ 2.10$ to 4.10$ illegally and without lawful authority.

Citing Chairman Federal Board of Revenue, Collector of Customs Model Customs Collectorate of Appraisement, Director General Directorate General of Customs Valuation and other as respondents, petitioner pleaded that the court may declare that act of the respondents illegal, mala fide and arbitrary. He also pleaded that the court may restrain them from charging extra amount on duty and taxes on its consignment.
