M/s M.J Textiles moves SHC against seizure of record by customs authorities

KARACHI: The Sindh High Court (SHC) has issued notices to the Customs Department on a constitutional petition filed by M/s M.J Textiles against detention/ seizure of the entire record in support of his lawful purchase and ownership of goods.

A two-member bench, comprising Justice Munib Akhtar and Justice Omer Sial, was hearing the petition.

Earlier, counsel for the petitioner stated that it is lawful engaged in the business of processing of textile material and never involved in any tax evasion or smuggling case. However, the customs authorities detained the entire record of in support of his lawful purchase and ownership of goods and allegation was fixed that the petitioner was allegedly involved in smuggling of the said goods.

The counsel further submitted that the customs authorities also issued show cause notice to the petitioner and going to take action against him.

Citing Chairman Federal Board of Revenue, Director Directorate General of Intelligence and Investigation-FBR as respondents, he pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, petitioner also pleaded the court to suspend the show cause notice and restrain them from taking any coercive action against it till final decision of the court.
