M/s Haji Adam & Sons moves SHC seeking restoration of sales tax registration

KARACHI: The Sindh High Court (SHC) on Monday issued notices to the Customs Department and deputy attorney general on a constitutional petition filed by M/s Haji Adam and Sons, seeking restoration of its sales tax registration.

While the hearing the petition, a two-member bench, headed by Justice Munib Akhtar, also directed them to file their respective para wise comments on the next date of hearing.

Earlier, counsel for the petitioner stated that petitioner’s sales tax registration has been suspended under section 21 (2) of the Sales Tax Act, 1990 read with rule 12 of sales tax rules 2006 without any prior notice or opportunity of being heard and the allegation that petitioner have made huge import of finished fabric and other items and declared supplies to un-registered persons as zero rated during the period from July 2016 to December 17, 2018.

Citing Secretary Ministry of Finance, chairman Federal Board of Revenue, commissioner Inland Revenue Zone-1, Regional Tax Office-III and others as respondents, counsel for the petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to restore its sales tax registration immediately and restrain them from taking any coercive action against the petitioner till final order in this petition.
