SHC seeks remarks on petition challenging VR No 1264/2018

KARACHI: The Sindh High Court (SHC) has directed customs officials to make sure filing of their comments on a constitutional petition filed by M/s Care Plastic Industries against the valuation of imported canvas hosepipes under Valuation Ruling No 1264/2018 on March 8, 2018.

A two-member bench, headed by Justice Munib Akhtar, was hearing the matter. During the proceedings, counsel for the customs authorities sought time to file comments; therefore, the court adjourned the matter.

Earlier, counsel for the petitioner stated that petitioner is lawfully engaged in the import of the goods and fulfills all the requirements in accordance with law. However, it is being aggrieved by the assessment of the customs authorities on the bases of valuation ruling 1264/2018 and enhanced the duty and taxes illegally. He argued that the action of the respondents is illegal and unlawful and has no legal effect.

Citing Chairman Federal Board of Revenue, Chief Collector of Customs Collectorate of Appraisement South, Chief Collector of Customs Collectorate of Appraisement Port Muhammad Bin Qasim as respondents, he pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court to set aside impugned valuation ruling and restrain them from taking any coercive action against the petitioner till final order in this petition.
