LAHORE: Customs Appellate Tribunal has dismissed the appeal filed by deputy director, Intelligence & Investigation-FBR Lahore against Muhammad Israr, proprietor of M/s Khan Electronics Circular Road Faisalabad.
Muhamamd Shabbir Gujjar, member judicial bench-I heard arguments and examined the record produced by the appellant and respondent and passed a judgment with remarks that in the presence of evidence discussed in details by the adjudicating authority and facts the impugned order is upheld.
As per brief history the case was reported on the information that huge quantity of smuggled goods was lying in the godown of M/s Khan Electronics situated at Professor Block, Shalimar Park Faisalabad.
The customs staff obtained search warrant from Magistrate and during raid recovered 65 foreign origin LEDs. On the spot Muhammad Israr Khan proprietor of said godown failed to produce the documents regarding lawful import of goods.
Adjudication proceeding were culminated who passed the Order-in- Original (ONO) with remarks that show cause notice is vacated and goods released to lawful owner unconditionally.
Being aggrieved with the order, appellant filed the appeal before the Customs Appellate Tribunal on the grounds that adjudication authority passed the order which is against the law, in mechanical fashion and passed without applying of judicious mind. On the other side, the respondent denied all allegations and appeal for the rejection of said case.
After hearing arguments from both sides, Customs Appellate Tribunal has decided the case and rejected the appeal by the department.
