SHC directs Customs to release consignment of steel wire rods

KARACHI: The Sindh High Court (SHC) directed customs officials to release the consignment of steel wire rods on bank guarantee on a petition filed by M/s AKK Enterprises seeking release order for its goods.

While the hearing of petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi, also issued notices to the customs officials directing them to file their respective para wise comments on next date of hearing.

On September 28, 2018, during the hearing, counsel for the petitioner stated that petitioner is engaged in the lawful business of steel products and always fulfills all the formalities .

He further argued that petitioner imported a consignment of steel wire rods and filed Goods Declaration (GD) as per valuation ruling; however, he is seriously aggrieved by formulate under captioned valuing ruling by additional 5% (for low-carbon wire rode) and further additional (for high carbon wire rode).

He submitted that due the disputed valuation and fixation of additional charges, consignment was stopped by the customs officials.

Citing chairman Federal Board of Revenue, Secretary Revenue Division, Director General of Valuation and others, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

Importer also pleaded the court to direct them to release his consignment and restrain them from taking any coercive action against the petitioner till final order in this petition.
