KARACHI: The Banking Court dismissed petition by National Accountability Bureau (NAB) for custody of Khwaja Abdul Ghani Majeed from jail to National Accountability Bureau (NAB) for inquiry of another matter which was booked in a scam of mega money laundering.
On February 8, 2019, court announced verdict which was reserved on Feb 7, 2019 and observed in its order that banking court has no power to transfer any accused that already confines in jail, however, if NAB authority wants any inquiry from said accused that inquiry can be carried out accordance with law.
During the hearing, Shahadat Awan, Jamshad Malik appeared behalf on above mentioned suspect, Abdul Fatah, special prosecutor for NAB represented NAB department.
Earlier, investigation officer argued and special prosecutor for NAB argued that chairman NAB issued warrants against the above-mentioned suspect in another inquiry; therefore, court may pass an order for transfer of his custody from jail to NAB authority.
However, Jamshad Malik advocate opposed and argued that NAB has no power to take custody of an accused that already confined in jail in judicial remand. After the hearing, the court had reserved order and directed both parties to submit their write comments.
According to the NAB sources, NAB officials have started consideration to challenge this order in apex court after approval of higher authorities.
It needs to be mentioned here that a two-member bench, headed by Chief Justice Ahmed Ali M Shaikh had dismissed petition filed by Khwaja Abdul Ghani Majeed son of Anwar Majeed, Chairman Omni Groups seeking bail before arrest against warrants and call-up notice issued by chairman NAB. Munir Bhatti Advocate had argued that before taking custody, direct NAB authority to disclose the material based upon which the personal attendance/ presence of the petitioner is required by the same.
