M/s Alina Engineering Works approaches SHC for restoration of ST registration

KARACHI: The Sindh High Court (SHC) issued notices to customs officials and deputy attorney general for next date of hearing on a petition filed by M/s Alina Engineering Works seeking restoration of its sales tax registration suspended by customs officials.

On February 22, 2019, while hearing the petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi also directed them to file their comprehensive para-wise comments on next date of hearing.

During the hearing, counsel for the petitioner stated petitioner is engaged in lawful import of second hand machinery and re-meltable scrap and always fulfills legal formalities as per law.

He submitted that petitioner imported the above mentioned goods from Sweden and filed goods declaration as per law, however, customs officials issued show cause notice to petitioner and suspended its sales tax registration without showing any reason.

Citing chairman Federal Board of Revenue, Collector of Customs Collectorate East and others as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, malafide and arbitrary.

He also pleaded the court to direct them to restore its sales tax registration immediately and restrain them from taking any coercive action till final order in this petition.
