Customs Court acquits suspect in mis-declaration case

KARACHI: The Customs Court awarded imprisonment and fine to suspect namely Tauseef Mirza and acquitted suspect namely Saqib Raza, who were nominated in a case of evading the payment legitimate revenue of the tune of Rs16,726,891 by mis-declaring the value in customs copy of goods declaration.

On July 29, 2019, court announced verdict and awarded imprisonment to suspect namely Tauseef Mirza for undergone period and fine Rs500,000 and if the fine amount is not paid the accused shall suffer for two years more, since charge is not proved against accused Saqib Raz, court acquitted him from charge.

According to the prosecution, M/s Nimir Chemicals Pakistan Limited, Lahore imported a consignment of 2-ethyle hexanol (octanol) (octyl alcohol) weighing no 1398CS120391 dated 19/06/2012 issued by M/s International Chemplast Private Limited, Karachi.

As per first information report (FIR) the goods arrived per M.T Loadstar Genesis vide inbounding (IB) of their imported goods through customs agent M/s Mufied Corporation declaring the value of goods as $203135.6400 in customs & clearing agent copies of goods declarations.

On physical examination on board the vessel the quantity of imported goods was found to be in excess of 0.28 percent the goods declaration was processed by assessing officer after adding in the quantity declared in goods declaration and allowed payment of 1% warehousing surcharge.

Representative of importer deposited 1 percent warehousing surcharging amounting to Rs194878.00 during the course of scrutiny by principal appraiser oil section, it was notice that the CFR values declared in customs & clearing agent in the copies of goods declaration do not matched with the importer’s and office’s copies of goods declaration. Thus they evaded the payment of legitimate revenue of the tune of Rs16726891 by mis-declaring the value in customs copy of goods declaration.
