M/s EI Abrar approaches SHC against higher valuation of imported kitchen cabinets

KARACHI: M/s EI Abrar approached the Sindh High Court (SHC) against enhancement of valuation of imported kitchen cabinets and accessories.

On 30 September 2019, counsel for the petitioner argued that during November 2018 to August 2019, petitioner imported eleven consignments of miscellaneous items, inter-alia including kitchen cabinets and accessories in SKD condition from Italy at the unit CFR value ranging $0.48 to $1.17 kg vide eleven goods declarations out of which nine goods declarations were processed and cleared through Port Qasim while two goods declarations were processed and cleared through Appraisement East.

He further submitted that to the utter dismay of the petitioner, the respective Collectorate assessed all the goods declaration at the assessable values of $ 4.50 per kg as per impugned valuation ruling no 1340/ 2018 dated 08/11/2018.

The said consignments were provisionally released against submission of pay orders/bank guarantees for the differential amount of duty and taxes on the orders of SHC dated 15/03/2019 and matter was not finalized yet, however, he was informed that respondents are going to en-cash the pay orders.

Citing Sectary Revenue Division, Director General of Valuation and others as respondents, petitioner pleaded the court may direct them not to en-cash the pay orders/bank guarantees which were procured for differential amount of duty and taxes of the petitioner’s consignments till final decision of the petitioners appeal sub-judice before the customs appellate tribunal.
