M/s Agrow Limited moves SHC against re-shipment of imported consignment

KARACHI: M/s Agrow Limited moved the Sindh High Court (SHC) and filed a constitutional petition seeking release order for its imported 4000 liters (20 drums @ 200 liters/ drum) of Shogun (Abamectin) 1.8% EC (W/V) manufactured by North China Pharmaceutical Group Aino Company Limited China.

On 26 September 2020, counsel for the petitioner submitted that petitioner dated March 17, 2019 booked a shipment of 4000 liters (20 drums @ 200 liters/ drum) of Shogun (Abamectin) 1.8% EC (W/V) manufactured by North China Pharmaceutical Group Aino Company Limited China.

He further submitted that supplier conducted analysis of subject product from inspection company control union before shipment, approved by department of plant protection Karachi which submitted their report dated April 20, 2020 with the remarks that the “product does meet the registered specification” whereas the said company issued their certificate of analysis dated April 09, 2020 wherein the subject product is qualified for import.

He argued that after arrival of the said shipment at Karachi Port, inspector of DPP, did not followed the standard procedures of getting the samples of pesticides which is to offload the drum from the container and rolled in before the getting samples whereas he got the sample from drum inside the container and he did not even allowed the authorized person of the petitioner to come near while getting such sample.

Counsel stays that on the basis of alleged sample the respondents issued pesticides analysis report dated June 05, 2020 with the remarks that “the above referred sample does not met the specification”.

Counsel argues that while ignoring sound, authentic, genuine and reliable grounds of the petitioner, the respondents order dated August 06, 2020 with the approval of plant protection adviser and director general issued direction to re-shipped consignment to its country of origin under the intimation of his office immediately.

Secretary National Food Security & Research, deputy director Registration Plant Protection Advisor & Director General, the Collector of Customs Appraisement –II as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He further pleaded the court to direct them to release the shipment and avoid occurrence any such act which is not permissible under the constitution.
