M/s Moonlight Trading moves SHC against detention of  sweater, upper & baba jackets’ consignment

KARACHI: M/s Moonlight Trading Company has approached the Sindh High Court (SHC) and filed a constitutional petition against blockage/ hold of imported consignment of garments inter-alia boy/ girl jacket/ sweater/ upper and baba jackets at a value of US$ 45, 506.70 allegedly due to mis-declaration.

On 27 April 2021, counsel for the petitioner stated that petitioner has imported garments inter-alia boy/ girl jacket/ sweater/ upper and baba jackets at a value of US$ 45, 506.70 and filed goods declaration according to law.

He submitted that on physical examination, it was alleged by the appropriate officer of customs department that item no 1 which was declared boy/ girl jacket assessable on US$ 1.75 per peace but it was found gents jacket made of artificial leather assessable on US$ 3.27 per peace, furthermore, it was alleged that item no 2 which was declared boy/ girl upper which is assessable on US$ 0.97 per peace while it was found boy/ girl jacket assessable on US$ 1.75 per peace vide valuation ruling no 1484/ 2020.

He further submitted that in additional on un-declared item gent woolen sweater quantity 6000 pcs was also found which is assessable on higher value, thus it was alleged that the petitioner attempted to conceal quantity of high value items by declaring less quantity for of item 01 was declared 34586 pcs while it was found 40586 pcs.

Counsel argued that his client denied all the allegation, however, a show cause notice was issued to the petitioner and passed order-in-original and blocked the said consignment.

Citing chairman FBR, collector of Customs Appraisement West and DG of Intelligence & Investigation-FBR as respondents, petitioner pleaded the court to declare that the blockage/ hold of impugned consignment imported by the petitioner after issuance of order-in-original by the adjudicating authority is illegal, mala fide and unjustified in the eyes of law, therefore, court may direct them to release the same immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
