KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to submit their respective para wise comments on a constitutional petition filed by M/s Pak Telecom Mobile Limited against detention of its imported consignment of RRU with sccessories seized by Collectorate of Customs Port Muhammad Bin Qasim.
On 1 September 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui heard the matter.
During the hearing, Zain Ali Jatoi appeared before the court, however, counsel for customs department and deputy attorney general of Pakistan sought time for comments on behalf of above-mentioned respondents.
Earlier, counsel for the petitioner has argued that petitioner has lawfully imported a consignment of RRU with accessories and filed goods declaration according to law, however, petitioner was shocked, when he was informed that petitioner consignment had been detained and allegation was fixed for mis-declaration.
He further argues that petitioner has serious apprehension because investigation officer appointed by customs department s called the petitioner and its officer and they were being harassed by the investigation officer of Intelligence & Investigation MCC Appraisement Port Muhammad Bin Qasim.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Appraisement Port Muhammad Bin Qasim and Director General Intelligence & Investigation-FBR as respondents, petitioner pleaded the court to declare that act of respondents is illegal, mala fide and arbitrary.
He further pleaded that the court to direct them to release his consignment immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
