SHC extends interim relief on petition filed by M/s Retail Solutions challenging VR No 863/2016

KARACHI: A two-member bench of the Sindh High Court (SHC), comprising Justice Shafi Muhammad Siddiqui and Justice Faisal Agha extended interim order and directed customs officials to file comments on a constitutional petition filed by M/s Retail Solutions against detention of imported consignment of toilet soap.

On 13 October 2021, during the hearing, counsels for the petitioner and customs department appeared before the court.

Counsel for the petitioner argued that his client is doing lawful business and during the course of business, petitioner imported a consignment of toilet soap assorted brands and filed goods declaration according with law.

He further argued that petitioner also requested customs officials to release petitioner’s consignment after filing goods declaration, however, petitioner was informed that consignment has been detained and valuation has been enhanced under the garb of valuation ruling no 863/2016 without lawful authority.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Deputy Collector of Customs and others as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.

He further pleaded the court to set aside impugned valuation ruling and direct them to release petitioner’s consignment immediately and restrain them from taking any adverse action against the petitioner till final order in this petition.
