SHC dismisses petitions filed by M/s Sugrah Enterprises

KARACHI: A two-member bench of the Sindh High Court (SHC) dismissed constitutional petitions as not pressed along with pending applications filed by M/s Sugrah Enterprises against detention of its imported consignment of Soaps.

On 22 December 2021, during the hearing, Rashid Khan Mahar advocate for petitioner, Kafeel Ahmed Abbasi and Hussain Bohra Assistant Attorney general appeared before the court.

During the hearing, learned counsel for the petitioner Rashid Khan Mahar, on instruction, does not press these petitions, accordingly, the same are dismissed as not pressed along with pending applications.

On last date of hearing, court had passed order that “this seems to be a covered case in terms of the judgment rendered in a no of cases, which bunch was disposed of by a common order in special customs reference application No 744/ 2016, although Kafeel Ahmed Abbasi is appearing as a DAG, no one is appearing behalf of the customs department.

As an indulgence, let notice be repeated upon respondent no 2 & 3 (Collector Customs Appraisement West and Director General Valuation), if, in case, no one appears on behalf of the said respondents, appropriate orders for a disposed of this petition shall be passed”.

Earlier, counsel for the petitioner stated that petitioner is doing lawful business and always fulfill all the legal requirement, and during the course of business, petitioner imported a consignment of soaps stock  weighing 208000 kg and after the fulfilment of all the legal formalities, filed goods declaration, however, customs officials hold petitioner’s consignment and enhanced valuation of imported goods without lawful authority.

Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement West and director General Valuation as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court may direct them to release the importer’s consignment and restrain them from taking any adverse action against the petitioner till final order in this petition.
