KARACHI: A two-member of the Sindh High Court (SHC) dismissed a constitutional petition filed by M/s Zubair Corporation as not pressed seeking release order of imported 40 metric tons of cutch block marka ZC super goods which were detained by customs officials.
On 1 February 2022, a two-member bench, heard the matter, during the hearing, Imran Iqbal Advocate for the petitioner, Aamir Rana advocate for customs officials, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the bench.
During the hearing, counsel for the petitioner submits that since filing of this petition, petitioner’s grievances has been redressed therefore, he does not wish to press the instant petition, after his statement, court observes that “accordingly dismissed as not pressed along with all pending applications”.
Earlier, counsel argued that petitioner imported 40 metric tons of cutch block marka ZC super at consideration of US$ 24,000 which were unlawfully taken away by the officials of the customs department along with vehicle from the petitioner’s rented godown after clearance of the same.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Collector of Customs Appraisement West, Collector of Customs Enforcement & Compliance (Preventive), Deputy Collector of Customs Anti-Smuggling Organization (ASO) and Director Intelligence & Investigation-FBR as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
Counsel further pleaded the court to direct them to release petitioner’s lawful imported goods immediately and restrain them from taking any adverse action against the petitioner till final judgment in this petition.
