SHC calls comments from customs officials on petition filed by M/s Attari Wires

KARACHI: A two-member bench of The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general of Pakistan and directed them to file their respective para wise comments for next date of hearing on a constitutional petition filed by M/s Attari Wires seeking release order for imported iron steel wire rope scrap’s consignment.

On 6 April 2022, during the hearing, Saleem Ul Haq appeared before the court and argued, after his arguments, court granted urgent application which was filed by counsel for the petitioner and observed in its order that “since the order the original has been passed thereafter counsel may seek legal remedy as provided to him under the law.

However, so far as the aspect of shifting the cargo to CPE bonded warehouse is concerned, let notice be issued to the respondents as well as DAG for next date of hearing”.

Earlier, counsel for the petitioner states in his constitutional petition that during the course of business, petitioner imported a consignment of iron steel wire rope scrap for re-melting and filed goods declaration according to law.

He added that petitioner was shocked when he was informed that allegation was fixed upon petitioner for mis-declaration and a show cause notice also was issued.

Citing Secretary Revenue Division, Collector of Customs s Adjudication as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

Counsel further pleaded the court to set aside impugned show cause notice as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
