SHC dismisses petition against SRB after assurance of no coercive action

KARACHI: The Sindh High Court (SHC) has dismissed a petition that had been moved by English Biscuit Manufacturing Company Pvt Limited against a Show Cause Notice of September 29, 2020, issued by the Sindh Revenue Board (SRB).

At the time of the petition’s hearing, Muhammad Inzimam Sharif, the petitioner’s counsel, had urged that the case in question was on par with a previous ruling of the court issued in the Fatima Fertilizers case (2020-PTD 484).

Agha Shahid Majeed Khan, counsel of SRB, replied that the defense could be put forward before the adjudicating authority. He promised the court that no coercive measure would be adopted against the petitioner until the case was decided in due course.

Considering the joint application of both sides, the court consented to reject the petition, assuring that the case would go on in accordance with the law and with no coercive measure in the interim.

This ruling highlights the significance of such cases being solved by legal procedures, giving importance to equitable resolution without coercive pressure.
