ADC Shafique Latki issues ONO against M/s Buraq Polyfabrics for duties/taxes evasion

KARACHI: Additional Deputy Collector Shafique Latki of the Collectorate of Customs Adjudication-II has issued an Order-in-Original (ONO) against M/s Buraq Polyfabrics (Private) Limited for duties and taxes evasion of Rs 153,529. A penalty of Rs 50,000 has also been imposed on the importer.

According to OnO, it has been informed by Directorate of Post Clearance Audit that during scrutiny of import data of coated calcium carbonate PCT Heading 3824.9094 and 3824.9099, M/s Buraq Polyfabrics imported two consignments of coated calcium carbonate through Customs Appraisement East by mis-declaring the goods under PCT Heading 3824.9094.

Thus by way of mis-declaration of description and classification of the goods, M/s Buraq Polyfabrics short paid Rs 153,529.

Accordingly, a show-cause notice was issued by Basit Hussain, the then deputy collector Customs BS-18 of this Collectorate to the importer. However, the said officer joined Mid Career Management Course at National Institute of Management, Karachi.

“I have gone through the record of the case. The allegation on the respondent is that they mis-declared the classification to get the goods cleared under PCT heading having lower rate of duty. As no one appeared to attend the hearing despite being given reasonable opportunities of hearings, thus, the charges leveled in the show-cause notice stand established”, the additional deputy collector said.

M/s Buraq Polyfabrics Pvt Ltd are directed to pay Rs 153,529 into the government treasury. A penalty of Rs 50,000 is imposed on the importer.
