Adjudication DC Asma orders to confiscate polyester thread, trucks

FAISALABAD: Collectorate of Customs Adjudication Deputy Collector Asma Hameed ordered to confiscate 543 cartons of foreign origin polyester thread and two trucks being used for transportation of smuggled items.

Deputy Collector Asma heard a case filed by Faisalabad Customs Anti-Smuggling Organisation (ASO) against Tanveer Ahmed and Waqar Hussain. She issued Order-in-Original (ONO) in favour of the customs department and ordered to seize the items along with trucks under the customs laws.

As per details, the ASO team following credible information intercepted two trucks bearing Registration No LES-7094 and LES-7366 Samanabad Sargodha Road, Faisalabad and recovered foreign origin polyester thread.

On demand, drivers of both trucks could not produce any documentary evidence regarding legal import or lawful possession of the loaded goods, therefore, the trucks were taken into custody along with polyester for further investigations under Section 168 of the Custom Act, 1969 violation of Section 2 (s) read with SRO-566(1), Section 3 of Sales Tax Act, 1990, Section 148 of Income Tax Ordinance.

Later, the case was sent to the Customs Adjudication for further legal action where customs representative Inspector Safdar Ali argued that the recovered items were brought into the country through an unauthorized route without payment of leviable duty and taxes and asked the court to issue order for confiscation of the goods.

However, the respondents could not defend the allegation of smuggling or produce any documentary evidence before the adjudication. Therefore, the deputy collector stated that it was crystal clear that the foreign origin seized goods were smuggled one and brought into country illegally by evading duty.taxes leviable thereon and ordered to impound the both trucks and polyester thread under Section 156(1) 89 of the Custom Act, 1969.
