Adjudication-I issues ONO against M/s Universal Enterprises for misdeclaration

KARACHI: Deputy Collector, Collectorate of Customs Adjudication-I, Moeen Afzal Ali has issued an Order-in-Original ONO against M/s Universal Enterprises Ltd for mis-declaration.

“ I have gone through the record of the case and verbal submission of the respondent advocate and department side. The importer imported privacy 400ML operation theater system large-lock connection in 18500 PCS under PCT heading 9018.3990 through Port Muhammad Bin Qasim at a unit value Euro 0.3415 per piece from Germany. It is evident from the history of the importers that a case of under valuation”, the DC stated in the ONO.

The importer failed to clarify as to on what basis they again mis-declared the value whereas their identical goods were released on Euro 1.0742 per piece on the basis of found invoice in the container at the time of examination. The importers however failed to come up with any tangible evidence and were also unable to refute the charges leveled by the department, according to ONO.

In view of the aforesaid M/s Universal Enterprises are held to have intentionally and willfully caused loss to the government exchequer amounting to Rs 605,651 by grossly mis-declaration of value as is evident from the history of the importer.

Now therefore, M/s Universal Enterprises is therefore called upon to show cause notice as to why evaded amount should not be recovered from you and penal proceedings should not be initiated against them for violation of above mentioned provisions of the law.
