Adjudication-II upholds contravention case against CMPAK; imposes Rs 3m penalty on importers

KARACHI: The collector of Customs Adjudication-II, Karachi has upheld the contravention report through its Order-in-Original No.115 of 2014-2015 dated June 2, 2015 on a case of evasion of taxes/ duties by CMPAK Limited, Islamabad.

The collector of Adjudication-II in the aforementioned ONO has upheld the contravention report made by Directorate General against CMPAK Ltd., Islamabad regarding mis-declaration of PCT heading of UPCC equipments which were wrongly cleared under PCT heading 8517.6970 on the payment of 1 percent customs duty, while the actual PCT heading 8517.6290 attracting 20 percent customs duty.

As such, the demand of evaded amount of Rs 113.3 million has been upheld for recovery from the importers.

The collector also imposed a penalty of Rs 3 million under clause (14) of Section 156(I) of the Customs Act, 1969 for violation of Section 32(I) ibid, on the importers, CMPAK Limited and also imposed a penalty of Rs. 500,000 on DHL Global forwarding Pakistan Private Limited, Clearing Agent (CHAL No. 2229) under the licensing rules for their dubious role in the case.
