Appraisement-West collector’s reply sought on determining high value of goods

KARACHI: The Sindh High Court (SHC) on Wednesday sought comments from the Customs Appraisement-West collector on a petition filed by Shoaib Lakhandwala, seeking release of a consignment of “scaffolding material casted fix coupler” and “scaffolding material casted pipes”.

A two-judge bench, headed by chief justice Sajjad Ali Shah, heard the application. During the hearing, the counsel for the respondent requested the court to allow some time to take instructions.

Earlier, the petitioner’s counsel stated that petitioner operates with the name and style of M/S Huseini Sulemanji and Co. and imported the consignment of “scaffolding material casted fix coupler ” and scaffolding material casted pipes” from China at the declared value $0.56 per kilogram. However officials of the customs refused to accept the value declared by the petitioner’s company without providing any lawful basis and illegally determined the value of goods at $1.10/kg.

The counsel argued that determination of value at $1.10/kg by the respondents is void and without lawful authority.

Citing FBR chairman, collector of Customs Appraisement-West as respondents, the petitioner pleaded the SHC to direct the respondents to release said consignment.
