KARACHI: Deputy Collector of Customs Appraisement West AIB (R&D) has submitted its comments before a division bench of the Sindh High Court (SHC) and requested the court for dismissal of a constitutional petition filed by M/s ABC Industries challenging valuation ruling no 1125(1)/2011.
On 14 September 2021, a two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal heard the matter.
During the hearing, Khalid Rajpar advocate appeared behalf of the Deputy Collector Customs Appraisement West AIB (R&D) and Chief Collector of Customs Enforcement South and submitted comments, he requested the Court to dismiss the subject petition being devoid of merit and direct the petitioner to submit the documents requested by the customs to process the goods declaration.
After the hearing, court directed counsel for the petitioner to submit his rejoinder and court also directed other respondents to file their respective para wise comments for next date of hearing.
Earlier, counsel for the petitioner stated in his constitutional petition that petitioner is a lawful importer and manufactures textile articles at its manufacturing unit and imported furnished fabric and filed a goods declaration.
He further submits that the petitioner was shocked when he came to know that customs officials fixed the allegation upon the petitioner and issued a show cause notice under the garb of valuation ruling no 1125(1)/2011.
Citing Secretary Revenue Division, Chief Collector of Customs Appraisement South, West and East and Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court to set aside impugned show cause notice and restrain them from taking any adverse action against the petitioner till final order in this petition.
