Appraisement-West to prepare contravention report against ICI Pakistan on violation of SRO1125 (I)/2011

KARACHI: The Model Customs Collectorate (MCC) Appraisement-West has decided to prepare contravention report (CR) against the importer ICI Pakistan in its alleged involvement in taking undue advantage of SRO1125(I)/2011 in clearance of huge quantity of chemical namely “WANNATE 8019”.
According to details, the AIB/R&D of MCC-Appraisement (West) in the month of November found that the importer M/s ICI Pakistan was involved in clearance of “WANNATE 8019 chemical through Goods Declaration (GDs) under PCT Heading 3909.5000 which was not appropriate in the clearance of the said chemical.
Subsequently, the AIB/R&D issued short revenue recovery demand approximately worth Rs10million against the importer M/s ICI Pakistan, which was challenged by the importer in Sindh High Court.
Meanwhile, the importer M/s ICI Pakistan has written letter to the Collector-MCC Appraisement (West) Muhammad Saleem in which they appealed the Collector to re-asses the cleared consignments and send those samples for laboratory test.
Considering the request of aggrieved party, the Collector directed the authorities concerned to send the samples of cleared goods for laboratory test.
Later, the test report of HEJ Laboratory endorsed the view point of Customs authorities and found that the cleared consignments were not fall under declared PCT Heading 3909.5000.
The Sindh High Court (SHC) has also rejected the petition of importer M/s ICI Pakistan and asked the Customs authorities to carry on its lawful procedures according with the Customs Act, 1969.
The SHC has also summoned the Customs authorities on 14-Jan-2014 to know about the departmental procedure against the importer M/s ICI Pakistan.
It may be mentioned here that the AIB/R&D of MCC-Appraisement (West) during the scrutiny of the data has found that the importer M/s ICI Pakistan was availing undue advantage of SRO1125(I)/2011 in clearance of the consignments of chemical namely WANNATE 8019”, sources revealed.
The AIB sources informed Customs Today that the Collectorate has decided to prepare contravention report against the importer M/s ICI Pakistan against its alleged involvement in tax evasion by violating the SRO1125(I)/2011.
The authorities concerned of the MCC-Appraisement (West) will send the contravention report (CR) to the Adjudicating authorities for further legal proceedings which include issuance of show-cause notice in the initial stage.
It is pertinent to mention here that the AIB/R&D of MCC-Appraisement (West) in a short span of time has taken up several cases of revenue shortfall reported from different importers in their alleged involvement in taking undue advantages of SRO1125(I)/2011, SRO551(I)/2008 and SRO421(I)/2007.
