Assistant Director (MIS) Najam dismissed

ISLAMABAD: Najam-ul-hassan, Assistant Director (MIS) (BS-17), has been dismissed from the government services for misconduct.

As per details, Najam was granted 730-day leave (without pay), however, after expiry of leave, the accused officer failed to resume duty as required under the rule. As the charge of unauthorised absence stood established, therefore direct show-cause notice was issued to the officer, but he did not reply. Thereafter the show-cause notice was also published in daily newspaper.

The accused officer submitted his reply and stated that he had already furnished resignation from service, and he proceeded abroad due to family issues under the impression that his resignation had been accepted. Examination of record reveals that he has not submitted resignation. The copy of resignation provided does not bear any receiving at the Collectorate of Sale Taxes, RTO Karachi which shows it was never furnished. Further there was no office of Collectorate of Sale Taxes, RTO Karachi in 2008.

After having gone through the relevant record including reply of accused officer the Member (Admn) being authorised officer concluded that the charge of misconduct stood established and recommended to the authority imposition of major penalty of “removal from service” under Rule 4(1)(b)(iii) of the Government Servants (E&D) Rules, 1973 upon the accused officer.

The secretary Revenue Division/FBR chairman being authority in this case accorded an opportunity of personal hearing on September 29, 2015. The accused did not appear in the personal hearing. However, in order to meet the end the justice another opportunity of personal hearing was accorded to him on April 15, 2016. The accused officer again did not appear in the personal hearing.

After having gone through record of the case and recommendation of the authorized officer, the secretary Revenue Division/FBR chairman, being the authority in this case, imposed major penalty of “removal from service” under rule 4(1)(b)(iii) of the Government Servants (E&D) Rules, 1973 upon Najam-ul-Hassan.

However, Najam-ul-Hassan, will have a right to appeals to the as Appellate Authority as provided under the relevant Rules.
