M/s Fauji Fertilizer contests show cause notices issued by FBR

ISLAMABAD: Appellate Tribunal Inland Revenue (ATIR) dated in office hearing of a case submitted by M/s Fauji Fertilizer Company Limited.

ATIR Account Member Dr Ghulam Mujtaba Bhatti heard the matter. This case was remanded back to the tribunal by the Islamabad High Court (IHC).

M/s Fauji Fertilizer Company Limited had contested show cause notices issued by the field offices of Federal Board of Revenue (FBR).

M/s Fauji Fertilizer Company Limited had challenged recovery of issued to it in head of outstanding income tax by the LTU, Islamabad.

M/s Fauji Fertilizer Company Limited had submitted the department had issued the demand for the tax year 2014 in head of income tax under provisions of Income Tax Ordinance, 2001.

Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, Commissioner Inland Revenue (Appeals) and Appellate Tribunal Inland Revenue (ATIR) were made respondent in the case.

M/s Fauji Fertilizer Company Limited prayed that the assessment order issued by the LTU officer was illegal, unlawful and without legal grounds.

The appellant had submitted before the court that the impugned order was issued illegally. It also stated that due legal course was not followed by the department in issuing the order.
