KARACHI: The Banking Court reserved judgment on transfer petition submitted by National Accountability Bureau (NAB) for custody of accused namely Khoaja Abdul Ghani Majeed from jail to National Accountability Bureau (NAB) for inquiry of another matter booked in a scam of mega money laundering.
On February, 2019, special prosecutor, investigation officer for NAB and Jamshad Malik appeared pm behalf of accused before the court, during the hearing, investigation officer argued that chairman NAB issued warrants against the above mentioned suspect in another inquiry therefore court may pass an order for transfer his custody from jail to NAB authority.
However, Jamshad Malik sdvocate opposed and argued that NAB has no power to take custody of accused already confined in jail in judicial remand. After the hearing, court reserved order and directed both parties to submit their write comments till tomorrow morning.
Another side, two-member bench, headed by Chief Justice Ahmed Ali M Shaikh dismissed constitutional petition filed by Khoaja Abdul Ghani Majeed son of Anwar Majeed, chairman Omni Groups seeking bail before arrest against warrants and call-up notice issued by chairman NAB.
During the hearing, Munir Bhatti argued that before taking custody, direct NAB authority to disclose the material based upon which the personal attendance/ presence of the petitioner is required by the same.
Citing chairman NAB, DG NAB, investigation officer and others as respondents, he pleaded the court to grant bail before arrest in the case for which the call up notice issued dated 23-01-2019 and restrain them from taking any coercive action against the petitioner. However, court dismissed petition along with listed applications.
