Collector Adjudication Asif Abbas declares seizure of black tea as legal

MULTAN: Collector Customs Adjudication Asif Abbas Khan issued Order-in-Original (ONO) against seized black tea and miscellaneous goods by declaring seizure as lawful.

According to the details, Anti-Smuggling Organization (ASO) team of the Multan Customs seized  a consignment of foreign origin non-duty paid miscellaneous merchandise goods including blankets, dish washing liquid, printing toners, laser jet cartridges, silky embroidery, black tea and certain other local origin goods loaded on a Hino Truck trailer displaying registration number TLV-717.

The above said goods were booked through M/s Lucky Peshawar Goods Transport Company located in Hawks Bay Road Karachi against various bilties on 21 February 2018 and they were trying to deliver the said goods from Karachi to Peshawar.

Anti-Smuggling Organization intercepted the said goods from Dera Ghazi Khan-Taunsa Road at Pull Qambar. Driver of truck produced different bilties showing booking of various kinds of merchandise goods by different consignors through goods transport company but these bilties were irrelevant and they were without any legal document.

Owners presented different documents photocopies to justify their possession but in the light of facts it proved that documents have been managed and are afterthought. Huge quantity of confiscated goods are not notified therefore an option under section 181 of the Customs act 1969 is given to the rightful owner for redemption fine equivalent to 20 % of the value of the seized goods in addition to leviable duty and taxes.

However, confiscated black tea is notified under section 2 (s) (ii) and the market value of the same is more than Rs4 million therefore it was confiscated out rightly. The truck was already released on the bank guarantee so bank guarantee furnished by the claimant of the seized vehicle should be en-cashed in favour of government against redemption fine.

Collector Customs Adjudication Asif Abbas Khan issued Order-in-Original no: 242 /2018 by declaring seized goods lawful in the seizure case.
