Collector Adjudication-I issues ONO against several importers for smuggling

KARACHI: The Collector of Customs Adjudication-I has issued Order-in Original (ONO) against M/s Badami Bagh Motors, M/s Malik Traders, Muhammad Ahmed, M/s Super Steel and claimant owners of the seized goods for their alleged involvement in evasion of duty and taxes of Rs 5,007,357 on account of seizure of smuggled, non-duty paid foreign origin electronic goods, electric lights, hardware goods, air filters, chemical and auto parts.

In ONO issued by the Collector Abdul Basit Chaudhry, he stated that “I have gone through the case record and considered the written and verbal arguments of the respondents and the department. In view of the reconciliation made by the Departmental Representative (DR) of the documents provided by the respondents, it is hereby ordered that:

M/s Electric-Karachi mentioned have produced import documents for electric lights that have been verified by the DR, therefore, these goods are released unconditionally”.

In the Order, the Collector further said that Muhammad Iqbal mentioned has produced import documents for Grease Pails that has been verified by the DR, therefore, these goods are released unconditionally.

The order further stated that a number of hearing opportunities have been provided to the respondents (claimant owners of the seized goods c/o M/s Haji Aziz Goods Transport Company, Karachi; but nobody has come forward to claim the ownership of the seized goods.

Hence, the charges leveled in the jn show cause notice stand established, and the seized goods being notified vide SRO566(I)/2005 are hereby ordered to be confiscated outrightly along with the Container No.SBAU-8455930 for violation of Section 2(s), 156(2), 157(1) and 178 of the Customs Act, 1969, punishable under Clause (14) and (89) of Section 156(i) ibid, read with Section 3(I) of the Import and Export (Control) Act, 1950.

Therefore, the Collector Abdul Basit Chaudhry has also imposed a penalty of Rs25000 on the owner of each bilty mentioned in this sub para under the above mentioned provision of law. The case was constituted by the Customs Collectorate Preventive-Karachi.
