Collector Adjudication Seema Raza seeks status of stay order granted to M/s Pepsi Cola

ISLAMABAD: Collector Adjudication Seema Raza once again issued reminder to the Collectorate to update the office of adjudication about vacation of stay granted to M/s Pepsi Cola International (Pvt) Limited by Islamabad High Court regarding contravention cases of incorrect classification of odoriferous substances based mixtures (concentrate).

According to notification no C.No. Cus/Coll/Adj/07/2015 the Collector Adjudication asked the Customs Collectorate to provide updated information regarding contravention cases against M/s Pepsi Cola.

In the notification it is stated that the adjudication proceedings in four show cause notices dated 29-9-2015, 28-10-2015 and 29-10-2015 against M/s Pepsi Cola are held up before adjudication Islamabad due to stay granted by the Islamabad High Court in writ petition No.115/2016 filed by M/s Pepsi Cola.

The stay was originally granted on 14-01-2016 against show cause proceedings with the observation that the said stay would be applicable up to next hearing.

Later on the honorable court maintained the extended relief vide order dated 24.11.2016, it noted that out of the cases above one has been reported by PCA Lahore.

It mentioned in notification that it may be underscored that last update received from MCC Islamabad on the status of stay informed that application for vacation of stay filed by MCC in the subject cases was fixed for hearing on 07-6-2017 but could not be taken up and was left over despite requests to MCC to provide regular updated status of stay granted by the Honorable High Court Islamabad, regarding its vacation or decision of the court in the writ petition if any to allow this office to proceed with adjudication whereas the notification noted that no further updates has been provided to adjudication office as yet.

It is emphasized through notification that considerable government revenue is stuck in the subject cases, it is therefore once again requested to update the office of Adjudication Islamabad because said office is dependent on information provided by MCC Islamabad on the status of stay as to indicating whether it is still held or not, so that the case may be accordingly disposed of on merit.
