Collector Javaid issues show-cause notice to BSN Medical for taxes evasion of Rs 13.464m

KARACHI: Chaudhary Muhammad Javaid, Collector, Customs Collectorate of Adjudication-II, has issued a show-cause notice to M/s BSN Medical (Private) Limited for evasion of taxes and duties to the tune of Rs 13.464 million on import of calcium sulphate.

According to details, the Directorate of Post Clearance Audit has found evasion of taxes and duties to the tune of Rs 13.464 million whereas it has referred the case vide its contravention report C.No PCA/4063/Audit/Dub-A/11608 dated 30.12.2015 to the adjudication for further proceedings.

In this regard, Collector Chaudhary Muhammad Javaid has issued a show-cause notice to M/s BSN Medical (Private) Limited, its clearing agents namely M/s H I Internatioal, M/s Okays Logistics and M/s Foreign Trade Associates.

Accordingly, M/s BSN Medical (Private) Limited have been called upon to justify its position as to why the evaded amount of duty and taxes to the tune of Rs 13.464 million may not be recovered from them and penal action under clause (1),(9), (14) of Section 156(1) of the Customs Act, 1969, Section 33(5) and Section 7-A of the Sales Tax Act, 1990 read with Chapter X of the Sales Tax Special Procedures, 2007 (Special Procedures for payment of Sales Tax by the importers) and Section 148 of the Income Tax Ordinance, 2001 may not be taken against them.

Hearing in this case is fixed for 29.3.2016 at 1400 hours. The importer and clearing agents may submit their written replies, if any. In case no one appears on behalf of the importer and clearing agents or no written reply is received by the stipulated date, the case will be decided exparte on merit as per available record.
