Collector Surraiya Butt issues show cause notice to Ericsson Pakistan on alleged tax evasion

KARACHI: Collector of Customs Adjudication-I Surraiya Ahmed Butt has issued a show-cause notice to M/s Ericsson Pakistan (Private) Limited for allegedly evading duties and taxes to the tune of Rs 528,126 on import of multi-purpose batteries and power backup equipment.

During the scrutiny of import data of telecom batteries for use in telescope exchanges falling under PCT heading 8507.2010, it was observed that certain mobile communication companies imported multi-purpose batteries and power backup equipment, evidently not for the use in telephone exchanges under this PCT heading, while such batteries are correctly classifiable under heading 8507.2090.

Thus by mis-declaring these multi-purpose batteries under PCT heading 8507.2010 they have made a deliberate and willful attempt to evade duty/taxes.

M/s Ericsson Pakistan (Private) Limited has imported telecom batteries for use in telephone exchange by mis-declaring them in the PCT heading 8507.2010 instead of declaring them under their correct PCT heading 8507.2090.

Thus, by way of mis-declaration of classification, M/s Ericsson Pakistan (Private) Limited with the active connivance of their clearing agent M/s Saspak Cargo (Private) Limited has evaded/short paid Rs 528,128.

The Collector Adjudication-I in the show-cause notice has directed the management of M/s Ericsson Pakistan (Private) Limited to depute a representative to appear on behalf of the company to justify whether they have evaded duties/taxes or not.
