Commissioner IR files petition in SHC against M/s Ghani Builders & Developers Pvt Ltd

KARACHI: The Commissioner Inland Revenue Zone-1, Regional Tax Office-II Karachi approached the Sindh High Court (SHC) challenging impugned order of the Appellate Tribunal Inland Revenue Karachi over impugned recovery from M/s Ghani Builders & Developers Private Ltd.

Counsel for the appellate stated in its income tax reference application that the taxpayer deals the business of construction of buildings etc, case of the respondent was selected for audit under section 177 of the Income Tax Ordinance 2001 and deputy commissioner IR audit-V, passed an order under section 122 (1) (5) and respondent was directed to pay impugned recovery.

He further informed the court that being aggrieved, said respondent filed an appeal before commissioner IR appeals-IV which was rejected, therefore, respondent again filed an appeal before the appellate tribunal IR Karachi and said tribunal passed order dated 20/01/2016, allowed relief of Rs, 150, 724, 310 instead of addition of Rs. 175, 500, 00 in terms of section 75.

Citing M/S Ghani Builders & Developers Pvt Ltd as respondent, applicant pleaded the court may set aside order of the tribunal and restore its order.
