Custom Court sends suspect on physical remand in copyright case

KARACHI: The Custom (Taxation and Anti-Smuggling) Court Judge Syed Faiz Rasool Rashdi sent the accused person namely Nadir Shah son of Noor Ali Lakhani, proprietor of M/s Nadir Electronics to Custom Department on physical remand for February17, 2017, booked in a case of copyright.

During the hearing, investigation officer, Shoukar Ali Malahn, inspector FIA appeared before the court and produced FIR 04 of 2017, along with above named accused person and informed that on complaint registered by Muhammad Qaiser son of Rana Ashfaq Ahmed manager operation, M/s KAD and Co International regarding pirated replicated/smuggled products networking cable CAT-5 & CAT-6 net cable patch cord containing name “Commsscope” being sold out in local markets by infringing copy right of actual copy right owner foreign firm M/s Commscope.

He submitted that on this complaint, a team comprising FIA officials, conducted a raid at M/s Nadir Electronics shop, Dubai Market, Sadder, Karachi and recovered huge quantity of pirated/replicated/ smuggled/ imported products networking cable CAT-5 CAT-6 net connectors, patch cord any many logo of “Commsscope”.

According to the prosecution, accused Nadir Shah was asked to produce legal and lawful documents of this goods but he failed to produce any lawful authority from manufacture firm to legitimate its status, therefore, after fulfilling the formalities, FIA team arrested him and case was registered in violation of under section 15, 156 (1) of customs act, 1969 read with section 56, 66, 66-A copyright ordinance 1962.

Investigation officer requested the court that prosecution require for physical remand of the above mentioned accused person for further investigation, after the hearing, court sent the accused to physical remand and directed the investigation officer to produce accused on next date of hearing along with progress report.
