Customs Appellate Tribunal accepts appeal in energy saving lamp import case

LAHORE: Customs Appellate Tribunal on Saturday accepted the appeal filed by M/s Hussain Trading Company against Collector of Customs Appeals and Deputy Collector Import Faisalabad and others.

Omer Arshed Hakeem, member judicial, bench-II, heard the case and examined the record which was produced by the parties. Tribunal passed the judgment that respondent failed to defend the allegations charged by the appellant so the appeal is accepted and Order-in-Original is set aside.

As per brief history of case, M/s Hussain Trading Company imported a consignment of energy saving lamp from China and importer allegedly mis-declared the value of imported items. The deputy collector passed the final assessment order and goods were assess @ USD 0.56 per piece and directed the importer to deposit duties and taxes mounting to Rs1,93,022.

Being aggrieved with the order, appeal was filed before the learned Collector of Customs (Appeals) who upheld the order in original passed by earlier authority.

Not satisfied with the order, appellant filed the case before the Customs Appellate Tribunal on the grounds that Order-in-Original is beyond the law and same is liable to set aside.

Adding more order passed in mechanical fashion, not according to the law facts related to the case are denied. On the other side, respondent denied all allegations.

After hearing the arguments from both sides, Customs Appellate Tribunal decided the case with remarks that order in original being devoid of merit and appeal is accepted.
