Customs Appellate Tribunal decides appeal in foreign origin compressors case

LAHORE: The Customs Appellate Tribunal has dismissed the appeal filed by the Director, Directorate of Intelligence and Investigation against Hassan Ali, a resident of Lahore.

According to the details, Muhammad Shabbir Gujjar, Member Judicial bench-II, decided the case and remarked that all the arguments were considered from appellant and respondent side and the tribunal learnt that the appeal was dismissed without any pressure.

As per the history of case, the staff of Directorate of Intelligence and Investigation visited M/s The Quetta Goods Transport Company where they found foreign origin used serviceable compressors for air conditioners.

On query, the company staff produce a bill of lading but he failed to produce documents regarding lawful import of the goods. The same goods were taken into custody and brought into the office for further investigations.

After the complete examination the same goods were seized under the section 168 (1) of Customs Act 1969. The Adjudication proceeding were culminated who passed the order against the appellant.

The appellant not satisfied with the order and challenged before the learned Collector of Customs Appeals who passed the order to release goods to lawful owner unconditionally.

Being aggrieved from the order and appeal was filed by the department against the earlier passed order with grounds that there are lot of question marks on the order is liable to set aside, but respondent denied. After complete hearing of appeal Customs Appellate Tribunal dismissed the appeal.
