Customs Appellate Tribunal directs to release vehicle after payment of penalty

LAHORE: Customs Appellate Tribunal has decided case of Sardar Muhammad versus Superintendent Intelligence and Investigation Faisalabad.

According to written judgement, Ghulam Murtaza Bhatti Chairman/member Judicaial bench-I remarks that the impounged vehicle to be release to lawfull owner on the payment of panelty of Rs.50,000.

The brief fact of case is that  the presuance of specific information the staff of Intellegence and Investigation- Faisalabad with the help of police was intercepeted truck with huge quentity of smuggled goods.

On querry, driver introduce himself as Sardar Muhammad and stated goods the foriegn orign goods imported legally.

After the iniatial inquerry the goods decleared smuggled under section (s) of customs act 1969 and goods were seized by the customs autharities under section 168 of customs act 1696.

The appellant aggrived from the order and filed the case in customs appellate tribunal on the grounds that the alligation against the appellant are not based on any evedience and reasoning. The alligations are based on the presumptions only.

After hearing the argument, chairman, member judicial bench one Ghulam Murtaza Bhatti decided the case and modify impunged order to release goods with the penalty.
