Customs Appellate Tribunal dismisses appeal in short payment case

LAHORE: Customs Appellate Tribunal has dismissed the appeal filed in short payment of duties and taxes of vehicle imported under the tax Amnesty Scheme. The same appeal was filed by the Collector of Customs Appeals against the Nawabzada Haider Mehdi and others.

Omer Arshed Hakeem, member judicial bench-II heard the case and dismissed the same with remarks that this tribunal feels no need to interfere in the case.

As per brief history of case, on the core controversy in the appeal, additional collector of Customs Anti Smuggling Organization observed that Toyota Land Cruiser was imported under Tax Amnesty Scheme but the laws dose not allowed and duties and taxes livable on the importer. Customs officer also charged Rs22,22, 048 on the importer due to short payment.

After show cause notice adjudication proceeding were culminated and Order-in-Original was passed with remarks that the department failed to justify allegations and law does not allow the same officer to inquire the case of such type so appeal is decided in favor of importer.

Being aggrieved from the order, appeal was filed before the the Customs Appellate Tribunal on the grounds that adjudication officer failed to appreciate the facts of case, order in original passed in arbitrary manner and against the facts and circumstances of case and liable to set aside. The respondent has denied allegations.

After hearing arguments from both sides Customs Appellate Tribunal has dismissed the appeal with remarks that tribunal feels no need to interfere in the same case.
