Customs Appellate Tribunal dismisses gold smuggling case

LAHORE: The Customs Appellate Tribunal (CAT) has dismissed case of Irfan Tariq, a resident of Karachi versus Collector of Customs Adjudication, Customs House Lahore.

According to details, Imran Tariq, Member Technical of Bench-II of Customs Appellate Tribunal said in the final remarks that he learned that the appellant has tried to smuggle the impugned gold jewellery by wrapping with his body but he failed to do so, Customs Appellate Tribunal did not find any reason to interfere with the order passed by adjudication officer.

The details of case are reported by the Superintendent of Customs Preventive present in the international arrival hall of Lahore airport. At the time of checking, the clearance of incoming passengers of Shaheen Airline from Dubai was going on.

On suspicion, person name Irfan Tariq was stopped to determine weather he was carrying anything objectionable with him. During the examination, the customs officials found some articles of daily use and documents.

The search of above passenger was conducted in presence of witnesses which resulted in recovery of the gold jewellery wrapped in polythene bags and concealed in the restraint belt fastened at his waist and ankle.

The weight of recovered gold jewellary was recorded 03.135 kilograms on demand, above passengers failed to produce any evidence in support of legal import of gold jewellery. After issuing of show case notice the impugned order passed by the adjudication authorities  that seized 03.135 kilograms of jewellery is hereby confiscated under section 156(I)8 of customs act 1969. Penalty of Rs1,000, 000 is imposed under section 156 (I)8. Appellant aggrieved from the order and filed the case in Customs Appellate Tribunal.

Customs Appellate Tribunal heard the arguments from both sides and dismissed the case with no order and maintain impugned order passed by Customs Adjudication.
